Construction company fined over repeated health and safety failures

A construction company based in the West Midlands has been fined after Britain’s workplace regulator identified repeated health and safety failures across four sites in the region.

An inspection by the Health and Safety Executive (HSE) in April 2024 at Ling Developments Limited’s site at The Crest, Oldbury Park, Telford, revealed inadequate welfare provisions. Issues included a lack of hot or warm water in toilet facilities and insufficient rest areas for workers. As a result, the company was issued two improvement notices requiring corrective action.

The investigation also found that this was not an isolated incident. On three previous occasions, the company had breached the same legislation. Despite earlier enforcement action and guidance from HSE inspectors, Ling Developments Limited continued to provide facilities that fell below the required legal standards.

Under the Construction (Design and Management) Regulations 2015, principal contractors are legally required to provide appropriate welfare facilities on construction sites. These include access to clean hot and cold or warm water, adequate seating and tables for rest, and suitable arrangements for workers to prepare and eat meals.

Ling Developments Limited, of Maypole House, Maypole Street, Wombourne, Wolverhampton, pleaded guilty to breaching Regulation 13(4)(c) of the 2015 Regulations. At Birmingham Magistrates’ Court on 13 April 2026, the company was fined £15,858 and ordered to pay £3,858 in costs.

HSE Inspector Natalie Spurrier said that basic welfare provisions, such as hot running water and suitable rest facilities, are fundamental requirements, not optional extras. She added that the company had failed in its duty to meet minimum standards, placing workers at unnecessary risk, and emphasised that HSE will continue to take enforcement action where standards are not met.
